1. Acceptance of Terms
By creating an account, signing in, or otherwise using HomeWiseWatch (the “Service”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy.
If you are using HomeWiseWatch on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and references to “you” include both you and that organisation.
If you do not agree to these Terms, you must not access or use the Service.
2. The Service
HomeWiseWatch provides tools for inspection dispatch, on-site capture with automatic watermarking (timestamp, GPS and heading), review workflows, and interactive H5 report delivery via revocable share links.
We may add, modify, or remove features from time to time. Material changes that degrade core functionality will be communicated in advance where practical.
3. Accounts and Roles
Administrators may invite members to a workspace and assign one of four roles: Administrator, Reviewer, Surveyor, or Client. Role-based access controls (RBAC) determine what each role can view or act upon.
You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at security@homewisewatch.com if you suspect unauthorised use.
You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.
4. Customer Data and Evidence
“Customer Data” includes every project, home record, task, media asset, annotation, review note, report and share link that you or your members create through the Service.
You retain all rights to Customer Data. You grant HomeWiseWatch a limited, worldwide, non-exclusive licence to host, process, display, transmit and back up Customer Data solely to provide, secure and improve the Service.
You are responsible for the legality of the data you capture and upload, including obtaining any consents required by applicable law before photographing property, premises or individuals.
5. Acceptable Use
You agree not to:
- Upload content that is unlawful, infringing, defamatory, or otherwise violates a third party’s rights;
- Tamper with, disable or remove watermarks, chain-of-custody metadata, or audit trails generated by the Service;
- Attempt to reverse-engineer, scrape, or circumvent the security, rate limits or access controls of the Service;
- Use the Service to create a competing product, or to transmit malware, spam or automated abusive traffic;
- Impersonate another person, organisation, or public official.
We may suspend or terminate accounts that violate these restrictions, with or without notice.
6. Reports and Share Links
Approved inspections may be rendered into interactive H5 reports. Administrators and reviewers can create, revoke or regenerate share links at any time.
Share links may have an expiration date (default 30 days). Revocation and expiry take effect immediately; recipients will no longer be able to access the report after that point.
You are solely responsible for the distribution of share links and for communicating any confidentiality expectations to the recipients you share them with.
7. Intellectual Property
The Service, including its software, user interface, trademarks, logos and documentation, is owned by HomeWiseWatch Inc. and its licensors and is protected by intellectual-property laws.
These Terms do not grant you any right, title or interest in the Service other than the limited right to use it in accordance with these Terms.
Feedback you provide about the Service is non-confidential; HomeWiseWatch may use it without restriction to improve the Service.
8. Fees, Plans and Trials
Fees, billing frequency and trial terms for paid plans are communicated at sign-up or in a separate order form. Unless stated otherwise, fees are non-refundable.
Taxes are additional where applicable. Fee changes will be announced at least 30 days before the start of the next billing period.
If a payment fails and is not cured within 14 days of notice, we may suspend the Service for the affected workspace.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, HomeWiseWatch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
HomeWiseWatch does not guarantee that the Service will be uninterrupted or error-free, that captured media will be accepted as evidence by any specific regulator, insurer or court, or that the Service will meet your particular business requirements.
10. Limitation of Liability
To the maximum extent permitted by law, HomeWiseWatch’s aggregate liability arising out of or relating to the Service will not exceed the fees paid by you in the 12 months preceding the event giving rise to the claim.
HomeWiseWatch will not be liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, goodwill, or data, even if advised of the possibility of such damages.
11. Indemnity
You agree to indemnify and hold HomeWiseWatch, its affiliates, and their respective officers, directors, employees and agents harmless from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your Customer Data, your violation of these Terms, or your infringement of any third-party right.
12. Termination
You may stop using the Service at any time. Administrators may close a workspace from the admin console or by contacting support.
We may suspend or terminate your access if you materially breach these Terms or if required by law.
Upon termination, you may export your Customer Data for 30 days; after that, we may delete it in the ordinary course of business. Sections that by their nature should survive (IP, disclaimers, liability limits, indemnity, governing law) will survive termination.
13. Changes to the Terms
We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page and, for material changes, provide additional notice (for example, via email or an in-product banner).
Continued use of the Service after an update constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws applicable at HomeWiseWatch Inc.’s principal place of business, excluding conflicts-of-law principles.
Disputes will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be resolved in the courts with jurisdiction at HomeWiseWatch’s principal place of business, unless mandatory local law requires otherwise.
